CONCERNING
AMENDMENT TO REGULATION OF THE MINISTER OF TRADE NO. 23/M-DAG/PER/6/2009 CONCERNING PROVISIONS ON THE IMPORT OF TEXTILES AND TEXTILE PRODUCTS

BY GRACE OF THE ALMIGHTY GOD,
THE MINISTER OF TRADE OF THE REPUBLIC OF INDONESIA,

Considering:

• a. that in effort to maintain and improve the competitiveness edge of national textile and textile products (TPT) industry, it is necessary to revise Regulation of the Minister of Trade No. 23/M-DAG/PER/6/2009 concerning Provision on the Import of Textile and Textile Products;
• b. based on consideration as described in paragraph a, it is needed to stipulate Regulation of the Minister of Trade;

In view of:

• 1. Trade Law 1934 (Statute Book of 1938 No. 86);
• 2. Law of the Republic of Indonesia No. 5/1984 concerning Industry (Statute Book of the Republic of Indonesia No. 22/1984, Supplement to Statute Book of the Republic of Indonesia No. 3274);
• 3. Law No. 7/1994 concerning the Ratification of Agreement Establishing The World Trade Organization (Statute Book No. 57/1994, Supplement to Statute Book No. 3564);
• 4. Law No. 10/1995 concerning Customs (Statute Book No. 75/1995, Supplement to Statute Book No. 3612) that is amended by Law No. 17/2006 (Statute Book No. 93/2006, Supplement to Statute Book No. 4661);
• 5. Law No. 5/1999 concerning Ban on Monopoly and Unfair Business Competition (Statute Book No. 33/1999, Supplement to Statute Book No. 3806);
• 6. Law No. 8/1999 concerning Customers Protection (Statute Book No. 42/1999, Supplement to Statute Book No. 3821);
• 7. Presidential Decision No. 260/1967 concerning Affirmation of Tasks and Responsibility of the Minister of Trade in the Foreign Trade Sector;
• 8. Presidential Regulation No. 10/2005 concerning First Echelon Organizational Units and Tasks of State Ministries of the Republic of Indonesia that is amended several times and the latest by Presidential Regulation No. 21 of 2008;
• 9. Presidential Regulation No. 47/2009 concerning the Formation and Organization of State Ministries;
• 10. Presidential Decision No. 84/P/2009 concerning the Formation of the Second United Indonesia Cabinet;
• 11.Decision of the Minister of Industry and Trade No. 141/MPP/Kep/3/2002 concerning Special Importer Identity Number (NPIK) that is amended by Regulation of the Minister of Trade No. 07/M-DAG/PER/3/2008;
• 12. Regulation of the Minister of Trade No. 01/M-DAG/PER/3/2005 concerning The Organization and Working Arrangement of the Ministry of Trade that is amended several times and the latest by Regulation of the Minister of Trade No. 34/M-DAG/PER/8/2007;
• 13. Regulation of the Minister of Trade No. 23/M-DAG/PER/6/2009 concerning Provisions on the Import of Textiles and Textile Products;
• 14. Regulation of the Minister of Trade No. 45/M-DAG/PER/9/2009 concerning Importer's Identification Number (API);
• 15. Regulation of the Minister of Trade No. 54/M-DAG/PER/10/2009 concerning General Provisions in Import;

DECIDES:

To stipulate:

THE REGULATION OF THE MINISTER OF TRADE CONCERNING AMENDMENT TO REGULATION.OF THE MINISTER OF TRADE NO. 23/M-DAG/PER/6/2009 CONCERNING PROVISIONS ON THE IMPORT OF TEXTILES AND TEXTILE PRODUCTS

Article I

Several provisions in Regulation of the Minister of Trade No. 23/M-DAG/PER/6/2009 concerning Provisions on the Import of Textile and Textile Products shall be amended as follows:

1. Article 10 shall be amended so that it read as follows:

"Article 10

(1) TPT as the result of manufacturing process from bonded zones which will enter other places in customs areas shall be exempted from provisions on the obligation of Textile-lP.

(2) TPT as the result of manufacturing process from bonded zones whose raw materials partly or wholly constitute TPT of import as contained in Attachment to this Ministerial Regulation which will enter other places in customs areas shall be subject to compulsory technical verification or trace.

(3) TPT as the result of manufacturing process from bonded zones whose raw materials partly or wholly originate from domestic products which will enter other places in customs areas shall be exempted from compulsory technical verification or trace.

(4) TPT as the result of manufacturing process as described in paragraph (2) shall be subject to technical verification or trace at bonded zones conducted by surveyors appointed under Decree of the Minister of Trade No. 948/M-DAG/KEP/7/2009 concerning the Naming of Surveyors to Conduct Technical Verification or Trace on the Import of Textiles and Textile Products."

2. Attachment I to Regulation of the Minister of Trade No. 23/M-DAG/PER/6/2009 concerning Provisions on the Import of Textiles and Textile Products shall be amended so that it becomes as in Attachment which is an integral part of this Ministerial Regulation.

Article II

This Ministerial Regulation shall come into force as from the date of stipulation.

For public cognizance, this Ministerial Regulation shall be promulgated by placing it in the State Gazette of the Republic of Indonesia.
